1. About the Site

The Site is operated by BESSARAB M.A., a digital marketing agency based in Ukraine ("we", "us", "our"). It provides information about our services, case studies and a way to contact us.

2. Inquiries are not contracts

Submitting a form, requesting an audit or emailing us does not create a client relationship or obligate either side to enter into an agreement. Our paid services are provided only under a separate written proposal or service agreement signed or accepted by both parties. If that agreement conflicts with these Terms, the agreement prevails for the services it covers.

Information on the Site, including service descriptions, timelines such as "3 weeks from kickoff to campaigns live", and prices if shown, is general and may change. Actual scope, timelines and fees are set in the written proposal.

3. Case studies and results

Case studies and metrics on the Site describe results achieved for specific clients in specific circumstances. Where figures are reported by the client, we say so on the page. Results depend on many factors including the industry, budget, offer, seasonality, sales process and market conditions. Past results do not guarantee or predict future performance, and we do not promise any particular outcome.

Where a metric is expressed as recorded revenue divided by ad spend, it is not a verified return on ad spend (ROAS). Currency conversions are approximate.

4. Intellectual property

The Site, including its text, design, graphics, layout and the BESSARAB M.A. name and marks, is owned by BESSARAB M.A. or its licensors and is protected by intellectual property laws. You may view and share links to the Site for personal or internal business purposes. You may not copy, reproduce, modify, distribute or create derivative works from the Site content without our prior written permission.

Client names, logos, brand identities and creatives shown in case studies belong to their respective owners and appear with their permission or for illustrative purposes only. They do not imply endorsement of the Site or of these Terms.

5. Acceptable use

You agree not to:

• Use the Site in violation of any law or third-party rights
• Submit false, misleading or another person's information, or spam through our forms
• Attempt to gain unauthorized access to the Site, our systems or other users' data
• Interfere with the Site's operation, including through scraping at a rate that burdens it, malware or automated attacks
• Use the Site to send unsolicited advertising or to harass others

We may restrict or block access to the Site if we reasonably believe these rules are being broken.

6. Information you submit

You confirm that information you submit through the Site is accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy. By checking the consent box on a form you agree that we may contact you about your request by email or phone.

7. Third-party links and services

The Site may contain links to third-party websites and use third-party services such as hosting and analytics. We do not control and are not responsible for third-party content, products or policies.

8. Disclaimer of warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, non-infringement or uninterrupted availability, to the fullest extent permitted by law.

Nothing on the Site is legal, financial, tax or investment advice.

9. Limitation of liability

To the fullest extent permitted by law, BESSARAB M.A. and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunities, arising from your use of or inability to use the Site or from reliance on its content. Our total liability for any claim relating to the Site is limited to USD 100. This section does not limit liability that cannot be excluded by law. Liability for paid services is governed by the applicable service agreement.

10. Indemnity

You agree to indemnify and hold BESSARAB M.A. harmless from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.

11. Governing law and disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Any dispute arising from them will be resolved by the competent courts of Ukraine, unless mandatory consumer protection laws of your place of residence provide otherwise. Before filing a claim, we encourage you to contact us so that we can try to resolve the matter informally.

12. Accessibility

We want the Site to be usable by everyone. If you have difficulty using it and would like to discuss accommodations, email bessarab.marketing@gmail.com.

13. Changes to the Site and Terms

We may change, suspend or discontinue any part of the Site at any time and may update these Terms. The "Last updated" date shows the current version, and continued use of the Site after changes means you accept the updated Terms.
